Custom Motorcycle Product Terms

Effective Date: July 23, 2026

1. Scope

These Custom Motorcycle Product Terms ("Product Terms") apply to all custom motorcycle products purchased directly from Born Scum, including but not limited to custom motorcycle seats, backrests, pads, and other made-to-order motorcycle products (collectively, the "Custom Products").

These Product Terms are incorporated into, and form part of, the Born Scum Terms of Service. In the event of any conflict between these Product Terms and the Terms of Service, these Product Terms shall control with respect to Custom Products.

By placing an order for any Custom Product, you acknowledge that you have read, understood, and agree to be bound by these Product Terms.

2. Made-to-Order Products

All Custom Products sold by Born Scum are manufactured to order based on the specifications selected by the Customer.

Because each Custom Product is produced specifically for the Customer, Custom Products are not stocked inventory and are not eligible for return under Born Scum's Return & Store Credit Policy.

3. Customer Responsibilities

The Customer is solely responsible for reviewing and confirming all order information before submitting an order, including but not limited to:

  • Motorcycle year, make, and model;

  • Product selection;

  • Design and stitch pattern selections;

  • Material and color selections;

  • Shipping address;

  • Contact information; and

  • Any other specifications applicable to the order.

Born Scum is not responsible for delays, incompatibility, additional costs, or other issues resulting from inaccurate or incomplete information provided by the Customer.

4. Fitment

The Customer is solely responsible for verifying that the selected Custom Product is compatible with their motorcycle before placing an order.

Any fitment information provided by Born Scum is offered solely as a convenience and may not account for aftermarket parts, custom modifications, production changes, or other vehicle-specific differences.

The Customer assumes all responsibility for verifying compatibility prior to purchase.

5. Final Sale

All orders for Custom Products are FINAL SALE.

Because each Custom Product is manufactured specifically for the Customer, orders may not be canceled, modified, returned, exchanged, or refunded once production has begun.

Requests to cancel or modify an order before production begins may be approved or denied by Born Scum in its sole discretion.

Subject to the Mandatory Consumer Rights provision of the Born Scum Terms of Service, all sales of Custom Products are final.

6. Production Timelines

Any production timeline, lead time, estimated completion date, estimated ship date, or anticipated delivery date provided by Born Scum is an estimate only and is not guaranteed.

Production timelines are determined solely by Born Scum and reflect Born Scum's manufacturing coordination, quality control, inspection, fulfillment process, and other operational factors. Estimated production timelines begin when Born Scum accepts an order for processing.

Customers should rely only on production timelines communicated directly by Born Scum.

Production schedules, lead times, estimated completion dates, or other delivery estimates published or communicated by any manufacturer, supplier, dealer, distributor, retailer, or other third party—including Saddlemen—do not apply to orders placed through Born Scum and shall not modify these Product Terms or create any contractual obligation on the part of Born Scum.

Customers acknowledge that information obtained from third-party websites, online forums, social media, dealerships, or other unofficial sources regarding production timelines is not binding upon Born Scum.

Production timelines may be affected by factors including, but not limited to:

  • Manufacturing capacity;

  • Material availability;

  • Supplier delays;

  • Quality control inspections;

  • Production scheduling;

  • Equipment maintenance or failure;

  • Holidays;

  • Severe weather;

  • Transportation interruptions;

  • Shipping carrier delays; and

  • Other circumstances beyond Born Scum's reasonable control.

Delays do not constitute a breach of contract and do not entitle the Customer to cancel an order, request a refund, or recover damages.

7. Manufacturing Process

Custom Products are manufactured by Born Scum's manufacturing partner according to the Customer's order specifications.

Upon completion, each Custom Product is shipped to Born Scum for inspection and quality control before being shipped to the Customer.

Additional processing time may be required after Born Scum receives the completed Custom Product to complete inspection, packaging, and shipment.

8. Order Status Updates

Due to the custom manufacturing process, Born Scum does not provide routine production updates while a Custom Product is being manufactured.

Unless Born Scum contacts the Customer regarding an issue affecting the order, Customers should not interpret the absence of updates as an indication that production has stopped or that a delay has occurred.

Born Scum's standard communication for Custom Product orders is a shipment confirmation notification when the completed order has shipped.

9. Customer Communications

Any production estimate, shipping estimate, completion estimate, anticipated delivery date, or other timeline communicated by Born Scum through the Website, email, telephone, text message, social media, live chat, or customer service is provided solely as an estimate and does not create a contractual guarantee.

No statement or representation made by any employee, contractor, representative, dealer, or customer service representative modifies these Product Terms unless expressly authorized in a written agreement signed by an authorized representative of Born Scum.

10. Shipping and Delivery

Once a completed Custom Product has passed Born Scum's quality inspection, it will be shipped in accordance with the Born Scum Shipping Policy.

Risk of loss, delivery, carrier delays, and all other shipping matters are governed by the Shipping Policy unless expressly modified by these Product Terms.

All Custom Products are shipped with Signature Required delivery.

The Customer is responsible for providing an accurate shipping address and for ensuring that someone is available to accept delivery.

If delivery cannot be completed, the carrier may make additional delivery attempts, hold the shipment for pickup, or return the shipment to Born Scum in accordance with the carrier's policies.

The Customer is responsible for monitoring shipment tracking information and making arrangements to accept delivery or retrieve the shipment if required.

Born Scum is not responsible for delays, storage charges, return shipping costs, redelivery fees, or other expenses resulting from failed delivery attempts, refusal of delivery, incorrect shipping information, failure to sign for delivery, or failure to timely retrieve a shipment held by the carrier.

11. Inspection Upon Delivery

Customers should inspect their Custom Product promptly upon delivery.

Any claim that an incorrect product was received, that the product was damaged during shipment, or that the product contains a manufacturing defect should be reported to Born Scum within fourteen (14) days after delivery.

Born Scum may request photographs or other information before evaluating any claim.

12. Manufacturer's Warranty

Certain Custom Products sold by Born Scum are covered solely by the applicable manufacturer's warranty, if any. Born Scum does not provide any separate warranty for Custom Products unless expressly stated in writing.

As of the Effective Date of these Product Terms, certain Custom Products are manufactured by Saddlemen and are covered by Saddlemen's Limited Warranty. Warranty coverage, eligibility, exclusions, and claim procedures are governed exclusively by the applicable manufacturer's warranty in effect at the time of purchase.

Warranty claims, repair or replacement decisions, warranty coverage determinations, and all warranty remedies are the sole responsibility of the applicable manufacturer. Born Scum is not authorized to approve, deny, or modify warranty claims on a manufacturer's behalf.

Customers seeking warranty service for applicable Saddlemen products should contact Saddlemen directly and follow Saddlemen's warranty claim procedures, including obtaining any required return authorization before returning a product. This direct contact process applies only to warranty claims. All other questions regarding orders, production, shipping, or customer service should be directed to Born Scum.

Nothing in these Product Terms modifies, expands, limits, or replaces any applicable manufacturer's warranty.

13. Installation

The Customer is solely responsible for ensuring that any Custom Product is properly installed.

Born Scum recommends installation by a qualified technician familiar with the applicable motorcycle model.

Born Scum shall not be responsible for damage, injury, loss, or expenses resulting from improper installation, improper maintenance, unauthorized modifications, misuse, or use of a Custom Product in a manner inconsistent with its intended purpose.

14. Product Appearance

Product photographs, digital renderings, videos, and other images are provided for illustrative purposes only.

Actual colors, stitching, textures, materials, leather grain, vinyl grain, and other aesthetic characteristics may vary due to manufacturing processes, lighting conditions, monitor settings, natural material variations, or other factors.

Accordingly, Born Scum does not guarantee that the appearance, color, texture, or finish of any Custom Product displayed on the Website or in marketing materials will exactly match the product received.

Such variations are normal, are not manufacturing defects, and do not constitute grounds for cancellation, return, exchange, refund, or warranty service.

15. Customer-Caused Delays

If the Customer requests changes to an order, fails to provide requested information, requests that shipment be delayed, fails to respond to Born Scum, or otherwise causes a delay in processing, production, or delivery, Born Scum may extend applicable production timelines as reasonably necessary.

Any Customer-caused delay shall not constitute a delay by Born Scum.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Born Scum shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the purchase, manufacture, shipment, installation, or use of any Custom Product.

Without limiting the foregoing, Born Scum shall not be liable for losses relating to cancelled trips, motorcycle rallies, vacations, races, events, hotel reservations, transportation expenses, lost income, loss of use, or any other costs arising from production delays or delivery delays.

18. California Proposition 65

Certain Custom Products may be subject to California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) and may include warnings required under applicable California law. Where required, Proposition 65 warnings will be provided on the applicable product page or with the product. Customers are encouraged to review all product warnings before purchasing or using a Custom Product.
